To je bolj kravja kupčija, če je zastavil hišo vredno 14M in dobil
8,4M kredita.Pri nas bi zastavil hišo, vredno 14M in dobil minimalno 140M kredita :)

To je bolj kravja kupčija, če je zastavil hišo vredno 14M in dobil 8,4M kredita.

Ne bo šlo kar tako preprosto, kot si naši paperpusherji in pisuni
predstavljajo. Lovše ni kupil vile na Floridi zaradi podnebja, ki
je mimogrede, obupno soparno, temveč zato ker so mu tako svetovali
njegovi odvetniki. Razlog pa so določbe Floridske Ustave, ki iz
stečajne mase v osebnih stečajih izključujejo določene sredstva, ne
glede na njihovo vrednost. Ustava pozna tki. "Homestead Exemption".

Da se bo vedelo kdo od naju ve o čem govori, predlagam tebi, da si
prebereš tole iz Ustave Floride, ki sem jo navedel kot vir. Očitno
se ukvarjaš z davki in poznaš navedeni pojem le iz davčnega prava,
kjer se pojavlja v povsem drugem kontekstu, jaz pa sem izrecno
govoril o spodnjem: "Florida Constitution Article X SECTION 4
Homestead; exemptions.--
(a) There shall be exempt from forced sale under process of any court, and no
judgment, decree or execution shall be a lien thereon, except for the payment of taxes and assessments thereon, obligations contracted for the purchase,improvement or repair thereof, or obligations contracted for house, field or other labor performed on the realty, the following property owned by a natural person:

Ustava Floride pod določenimi pogoji ščiti svoje rezidente, tako
da, med drugim, prepoveduje, da njihovi upniki v postopku osebnega
stečaja zahtevajo sodno prodajo dolžnikove hiše, če je ta njihovo
prebivališče. Omejitve so časovne in velikostne, glede na to ali je
nepremičnina v mestu ali zunaj njega, ne pa tudi vrednostne, zato
se kot zaščiteno prebivališče uporabljajo tudi zelo drage vile.
Zadeva je postala svetovno znana, ko se je na Florido iz tega
razloga preselil O.J. Simpson, takoj ko je bil oproščen v kazenskem
postopku, čakala ga je pa še civilna odškodninska tožba.
